These General Terms and Conditions are an integral part of the contract and apply between Beijing Lewei IOT Technologies Co. Ltd (hereinafter referred to as IAMMETER) and the user (hereinafter referred to as the customer) of the IAMMETER service for all present and future transactions and services of IAMMETER with the customer.
The customer is aware that additional general provisions may apply to the download of apps (especially those of the respective app stores). These additional general provisions remain unaffected by these terms and conditions.
The customer's general terms and conditions do not apply, even if IAMMETER does not expressly contradict them.
The presentation of various services at www.iammeter.com does not constitute a legally binding offer but rather a non-binding online description.
The use of the IAMMETER service and its associated features requires customer registration and the creation of a customer account. To do this, the registration form provided by IAMMETER must be used.
Upon submitting the registration, you will receive a confirmation email from IAMMETER. The contract with IAMMETER is concluded upon receipt of this email.
Customers are obliged to provide the complete and accurate data requested during registration. The customer is responsible for ensuring the confidentiality of their account, password, and restricting access to their computer and/or mobile devices.
IAMMETER is entitled to delete customer accounts that contain incomplete or incorrect data.
The type and scope of contractual services are determined by the service description, tariff price list, and any other agreements between the contracting parties.
IAMMETER is authorized to engage third parties (subcontractors) to provide the services.
The tariffs specified in the tariff price list do not include costs from third-party/integration partners. If additional third-party costs arise during the contract period, these may be passed on to the customer. The customer is granted a special termination right for this purpose.
IAMMETER guarantees a 99.9% availability of the provided service on an annual average. Excluded are times when the server is not accessible due to technical issues beyond the control of IAMMETER (especially force majeure, third-party fault). Also excluded are planned maintenance work (e.g., updates) either outside the regular business hours from Monday to Friday (considering all public holidays in China) between 9:00 and 18:00 or previously announced.
IAMMETER points out:
The customer is obligated to pay the agreed fees on time.
The customer is further obligated to keep their personal passwords and access credentials confidential and to change them immediately if there is a reasonable suspicion that unauthorized third parties have gained knowledge of them.
The customer is obligated to promptly inform IAMMETER if their name (in the case of companies, also changes to the company), residence or business address, billing address, bank details, or provided email address changes.
The entire content contained or provided by IAMMETER in a service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, and data collections, is the property of IAMMETER or third parties supplying content and is protected by the copyright and database rights.
The entire inventory of content contained or provided by IAMMETER in a service is the exclusive property of IAMMETER and is protected by the copyright and database rights.
The customer may not systematically extract and/or reuse parts of a IAMMETER service. In particular, the customer may not use data mining, robots, or similar data collection and extraction programs to extract any substantial parts of a IAMMETER service for reuse (whether singular or multiple). The customer may not create and/or publish their own database containing substantial parts of a IAMMETER service.
The prices to be paid by the customer are determined by the applicable tariff price list. The invoiced fees are due for payment without deduction upon receipt of the invoice and must be credited no later than the tenth day after receipt of the invoice.
The customer receives invoices in electronic form.
If the PayPal or PayPal Express payment service is selected, you will be redirected to the website of the online provider PayPal during the order process. To pay the invoice amount via PayPal, you must be registered there or register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal immediately afterward. Further instructions will be provided during the order process.
